On Oct. 12, 2010, New York State's "No Fault" law went into effect. This law states that a spouse whose marriage has been "broken down irretrievably for a period of at least six months" can obtain a divorce without the requirement that the other party is proved to be at fault (cruel and inhuman treatment, abandonment, constructive abandonment, adultery).

Courts and spouses no longer have to waste resources litigating whether a divorce should be granted. We can now better focus our attention and resources on issues such as the welfare of any children involved, equitable distribution of marital assets and debts, and other economic and fairness concerns.

This law also provides some relief to those living in relationships which failed through no one's fault.

To assist a spouse with little or no income during the litigation period, New York State passed a law providing for temporary maintenance (spousal support) and temporary attorney's fees. These laws ensure that all parties have the financial support and legal representation they need while preparing their cases.

It also helps to prevent situations where the monied spouse could force an unfair settlement by withholding funds from the other party.
